McCloskey and City of Toledo Answer Schulz Complaint - Check out www.davidschulz.com - COBRA Files for the answer to the Quo Warranto Complaint against Bob McCloskey. The answer was filed today after McCloskey was ordered to file an answer within 30 days. Would be interested in a lawyer's (arm chair lawyers and interested bystanders of Toledo politics) take on their answer.

I think the McCloskey response was rather weak. They should have taken more time with it, I'm also surprised that Bob is letting the City represent him since in the civil case he has the city paying for his own private attorney.
I'm wondering if the "retirement" of Barb Herring has anything to do with trying to get this done before a new Law Director is appointed.
I don't think the case will be dismissed. Especially given the answer. It places too much on the "ripe" issue. If that is thrown out (which it should be) there's not much else of a defense left.

I'd also toss in that the precedence of "Quo Warranto"? Seems pretty well established.

That's a great idea. Let me think about it. I think regardless, this meeting will be a zoo with the council presidency to be decided. It certainly could provide some more media coverage on the issue. The issue now in Today's Blade is that Bob may be hedging his bets and may not stand to be sworn in and go back to his district seat. We have to watch what the court does next week. I suspect it won't be decided unless Bob makes a move.
We could have a ceremonial burning of the city charter...

IF we can find enough of it to burn, after the way it's been trampled on and shredded by recent and past Councils, not to mention puppet-like Law Directors and their "tailored" responses and opinions...

I wish George Sarantou would be Council Prez.
"The next president, Mr. Sarantou said, should be an at-large councilman rather than a district councilman who is elected by only one-sixth of the city's voters. He has said the president of council also should be someone with prior council experience and a record of leadership on council, like himself."

I would assume that George can't support Bob with this reasoning. I think saying that a District Councilman can't be president is awful elitist. I hope no Republican would support McCloskey. We have to stand for something!!!

Dec 30 psyche777 blog posting about Bob Frantz softballing Bob McCloskey when the two Bobs talked on Frantz's radio show yesterday evening.
"I listened with disbelief as all that happened was what could only be described as a public relations event for Bob McCloskey. The lie detector test? Oh gee, sorry guys, his attorney said he couldn't do it. He really wants to, and he meant it at the time. I couldn't believe Bob Frantz bought that as an excuse."
"He allowed Bob McCloskey a public forum when his version of the truth wasn't even challenged. We do know that poor Bob Mc is suffering from alot of stress over the Blade's "constant and constant and constant" negative articles about him. He's claiming that he had the support to win the Council President seat until that mean and nasty Toledo Blade wrote about him."
I also heard the Friday evening radio show, and McCloskey definitely tried his best to garner sympathy for his health and family over the alleged negative Blade reporting.
Let's see, McCloskey blatantly violates the city charter and misrepresents himself by saying "Re-elect" on his campaign signs, among other things, and McCloskey wonders where all the supposed negative reporting came from? His lawyer advised McCloskey to not go through with his own challenge of taking a lie detector test because of a lawsuit. Which lawsuit? McCloskey is involved in more than one lawsuit, right?
I had to leave the house Friday evening, so I taped Frantz's show, since last I checked, WSPD doesn't provide audio downloads of the show for some strange reason. I'll provide quotes from McCloskey.
In the blog posting, psyche777 provides a nice timeline of Blade articles about Bob McCloskey over the past couple months.
