RICO: A New Tool for IMMIGRATION Law Enforcement (matricular consula ID cards) - I did a search and found several 'closed' threads regarding the acceptance by Toledo/Lucas County of the Matricular Consula ID Cards as valid identification for Illegal Aliens. If someone can point me in the right direction, I am currently researching whether or not these cards are being accepted for issuance of 'welfare benefits' such as: medicaid, food stamps, housing vouchers, cash assistance or by the BMV to gain driver's licenses and subsequently voter registration, in both Lucas and Wood counties. WHY?

ALL Government and Private entities, including banks, who accept this card as a form of identification may be subject to RICO prosecution, with a plaintiff award of triple damages. (RICO....just doing the job our federal and local governments won't)

......"Another predicate act that would make an employer liable under RICO is encouraging or inducing "an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law."16  The Fourth Circuit Court of Appeals has specifically interpreted this provision to apply to actions that encourage illegal aliens already in the United States to remain or that induce further illegal immigration.17  The Fourth Circuit held that "‘encouraging’ is not limited to bringing in, transporting or concealing illegal aliens. Rather, ‘encouraging’ relates to actions taken to convince the illegal alien to come to this country or to stay in this country."18  The Court held that a range of activities would meet this definition — fertile ground for a good plaintiff attorney.

One way to encourage illegal immigration is to accept foreign-issued identification documents, such as the "matricula consular" card issued by the Mexican government, THAT ARE ONLY NEEDED BY ILLEGAL ALIENS. Mexican consulate offices in the United States issue the cards to Mexican nationals living here, without regard to the immigration status of the recipients. Since all legal immigrants and foreign visitors have access to legitimate U.S.-issued identification, such as a passport with a visa stamp or a green card, only illegal aliens have need to rely on the matricula card to establish identity. Acceptance of such a card as valid U.S. identification would certainly facilitate the entry of illegal aliens into American society, and any BANK, MUNICIPALITY, OR OTHER ENTITY that accepts the card, knowingly provides benefits — such as the ability to open bank accounts or access public services — to illegal aliens usually reserved solely for US citizens or legal residents. Though there is no court opinion yet that speaks directly to this new issue, it is not unreasonable to argue that such a practice could be found to encourage illegal aliens already in the United States to remain.

Acceptance of the matricula card also induces further immigration because those contemplating illegal entry will be more likely to do so given the added benefits they can hope to obtain with a matricula card once inside the United States. Thus, acceptance of the matricula for financial gain may serve as a predicate act under RICO. If an entity, for financial gain, accepts the matricula on more than one occasion, it engages in a pattern of racketeering activity in violation of §1962 of the RICO Act."....................

Did you know those MC cards are issued by the mexican government, but are not legal identification in MEXICO???

Yes, I did know....and if the U.S. had anything close to the same immigration laws as Mexico, we wouldn't be in the situation we are in!

Here's to hoping that those greasy palms are 'sweating it out'. I'm convinced that the sudden RUSH by Bush/D.C. leadership to pass their 'comprehensive immigration reform' and the reason they are blackmailing us by refusing to pass border security without it, is the need to quickly grant employers amnesty in light of the pending and future RICO suits.

Every employer of illegals should face RICO prosecution.

Every government or private entity that accepts the MC ID cards should be facing RICO prosecution.

I am permanently disabled in Wood County. I should be first in line for assistance, but I've been unable to get housing assistance because there are NO FUNDS available. If I discover through my research that the reason NO FUNDS are available is because assistance is being given to illegal aliens, I will be contacting Howard Foster to consider a RICO claim.

If we really stop to think about it, I believe that more often than not, legal immigrants and American citizens have been negatively affected by illegal immigration, either on a personal, local, or state level and successful RICO prosecutions may be the best way to get it stopped. Otherwise there will be NO STOPPING Bush and the open borders politicians intent on selling out our sovereignty.

I know I clearly recall Lucas County Commissioner Pete Gerkin and his sidekick Tina shoving this "matricula consular" card bullcrap down our throats.

All legal immigrants already have identification, it's called an Employment Authorization Card, and it's issued by The Department of Homeland Security, Pete. My law-abiding british-citizen wife has one. Because my wife is following the application process by the letter of the law, she has a SS#, a Driver's License and no need for "excuses to violate federal law legally" with a cheap immigration card.

Ohh wait, my wife isn't even ELIGIBLE to receive this "immigration card" anyway because it's ethnically biased, which in turn is discrimination. We discriminate against legal immigrants with illegal immigrants. Wow Pete did his homework.

Altho I am sensitive to the plight of the mexican immigrant, as an American, I am insulted by this violation of Homeland Security by a nit wit and his pet president of their pandering to the hispanic community by breaking the law.

Pete, you f*cked up big time, and this is all your fault. This "matricula consular" card was illegal when you pandered to FLOC and it's illegal contingent and it is refreshing to see the card being denied in the community. If you're legal, you get a green card. I've already called "shennagans" on you Pete, now I hope to get to cash in on your stupidity.

There is a standard periodic publication that you can get under subscription, which lists photos of all the ID in America that is accepted for various purposes. Bankers use it all the time. Mexico's "matricula consular" ID is proudly displayed there. There are also other forms of ID for resident and visiting aliens, too, but they are not used so widely and purposefully as the MC ID is.

Mraz, you're right. The MC ID really IS only being used for illegal aliens.

Banks in particular are very accepting of this crap since they are whoring for customers and are seldom concerned about the legal or moral details. They hide this whoring under many layers of assertions to the contrary, but that's all PR. I took a friend into a bank just the other day to make a large monetary transaction. The bank's idea of complying with the USA PATRIOT Act was to simply ask him questions like "are you an agent of a foreign government?", etc. Gee, even if he WAS an agent of some foreign government, he would still have said "no". No lie detector was visible in the office. These so-called legal checks and balances are just jokes to keep the public laboring under the illusion that banks give a toss about where the money's coming from.

Go get 'em, Mraz. It can only stand to reason that American citizens come first when the issue is goods and services from the US government.

Hopefully Obrador gets elected and makes Mexico more responsive to its poor and hence make the nation a place worth staying in.

David Klehm, Esq., and I believe an associate of RICO attorney, Howard Foster, was interviewed this morning on Fox. Hopefully he has much success in California and his efforts to hold employers of illegals accountable, spreads across this country.

Banks are particularly vulnerable to RICO prosecution and to my knowlege, unlike the 'amnesty for employers' found in S. 2611, there is no RICO protection/amnesty for financial institutions who accept MC ID cards (or municipalities who accept it for driver's licenses). But I'm sure its probably buried in there somewhere. There's lots of crazy stuff in that bill that hasn't been uncovered, yet.

It would take just the right individual, with just the right circumstance, and I'll bet there could be a successful RICO prosecution against FLOC, the City of Toledo and officials involved in the decision to accept the MC ID cards, thereby ENCOURAGING illegal immigration. For instance, a company who hires LEGALS, but whose business has suffered or closed due to a competitor, one affiliated with FLOC, who hires ILLEGALS. There are several examples in the Center for Immigration Studies link above.
