A family member will be evicted soon, he says that in eviction day the officer will come with a crew and they will move his things into a container. I say that not, they will place everything at the curb. He lives in Toledo.
Evictions?

Thanks,
That is what I told him. He took a subprime credit and wasn't able to continue paying when the interest rate went up. In couple of months he lost his house.
Landlords and mortgage holders are under no obligation to store a former resident's property after the exceution of the eviction notice, provided there has not been the issuance of a stay order. Some kind souls will do so, but ultimately it is the responsibility of former residents to collect their property.
Be sure to check out the Foreclosure Intervention FAQ that the Ohio Treasurer posted.
Also, occupants must be given a 3-day notice of eviction:
ORC 1923.04 - ...a party desiring to commence an action under this chapter shall notify the adverse party to leave the premises, for the possession of which the action is about to be brought, three or more days before beginning the action, by certified mail, return receipt requested, or by handing a written copy of the notice to the defendant in person, or by leaving it at the defendant’s usual place of abode or at the premises from which the defendant is sought to be evicted.
Every notice given under this section by a landlord to recover residential premises shall contain the following language printed or written in a conspicuous manner: “You are being asked to leave the premises. If you do not leave, an eviction action may be initiated against you. If you are in doubt regarding your legal rights and obligations as a tenant, it is recommended that you seek legal assistance.”

Curb. I've seen it directly. Don't count on encountering a "kind soul" -- you'd be hard-pressed to find a landlord or bank that fits that description. Of course, you'd also be hard pressed not to find a fucking deadbeat associated with these filthy landlords and banks.
Fernando, make sure you smack your friend upside the head and then some, for signing a stupid mortgage like that.
Also, evictions generally take a while to occur. We're talking at least 28 days. You can't sell me on the idea that those evicted just didn't see it coming. That's bullshit; THEY KNEW. 28 days is plenty of notice, and with the issuance of demand letters and possible court action, there's even MORE time.
If all this foreclosure action is happening to your friend in the minimum possible time, Fernando, then that is likely to mean that the scumbank who has the house is trying to flip it onto another subprime moron.
"Subprime Moron". Well said GuestZero. I say they get what they deserve. Read the contract you are signing and pay your God-damn bills.
