That's a long road. Not sure "Anthony Wayne Trail in Lucas County" the morning of the planned checkpoint meets the requirement that the location be announced 24 hours in advance.

Last time, it was in front of Parkway Plaza. I wonder if they really withheld the address this time, if it's sloppy reporting, or if the OSHP asks for vagueness

Here's The Blade link, so, yeah. Vague.

It appears the exact location is being withheld. I encourage anyone to give the Toledo Patrol Post a call at the following number to ask for more information about the checkpoint.

(419) 865-5544

It's right at the entrance to the zoo.

What is the purpose of announcing these locations ahead of time? Is this something they have to legally announce or are they announcing it to discourage drunk driving in those areas???

If someone know there is a checkpoint and they drive drunk they will just avoid that area that night. Seems like it would make a lot more sense to have check points in areas that have problems with drunk drivers and not announce it.

Yes. It is the way they got around the Bill of Rights, I think.

Yeah, Benjamin Franklin was frequently getting pulled over for drunk driving, so he put a lot of pressure on James Madison keep the fuzz off his back.

No. He was getting pulled over for driving.

DWB. Driving while Benjamin.

I dunno, I think the whole situation got twisted when he tried bribing the officer. He tried handing the cop a $100, then claimed he mistakenly thought he was pulling out his ID. If only he hasn't used the "don't you know who I am?" comment...

"Benjamin Franklin was frequently getting pulled over for drunk driving"

Possible. Ben may have been a homebrewer. He enjoyed beer, but he liked wine more. Jefferson and Washington had breweries. They could have corrupted Ben.

Jefferson's wife brewed 15 gallons of low-alcohol beer every two weeks.

Attagirl.

I don't understand the complaint of people's rights being violated. How is this any different from the camera's or a speed trap?

Is you asked me Classylady, sobriety checkpoints, cameras and speed traps are all violations of rights. Re: check points, they have no reasonable cause to stop me and should not be allowed to.

You know they are check points that stop the free travel of law abiding citizens, without reason or probable cause... which is very much different than passive devices or witnessing officers that catch people breaking the law, right?

At a so-called "sobriety checkpoint," motorists are stopped, questioned, and maybe searched for no reason, except for the fact that people with guns have established a blockade of sorts.

Wikipedia : Fourth Amendment to the United States Constitution

... prohibits unreasonable searches and seizures ...

Who gets to define "unreasonable"?

But wait, there's more from that page with my edits added:

Where society's need is great, [f*ck that] no other effective means of meeting the need is available, and intrusion on people's privacy is minimal, [f*ck that too] certain discretionless checkpoints toward that end may briefly detain motorists.

In United States v. Martinez-Fuerte (1976), the Supreme Court allowed discretionless immigration checkpoints.

In Michigan Dept. of State Police v. Sitz (1990), the Supreme Court allowed discretionless sobriety checkpoints.

Unreasonable.
Minimal.
Discretionless.

It depends upon who gets to write the dictionary.

Society's need was greater for freedom. It's been a tough 15 years or so for freedom. The loss of freedom is increasing faster than the rate of drunk driving, I'd bet. And when we look at the numbers? Hundreds, often more than 500 motorists impacted in one or more incremental instances of unlawful search, questioning and detainment. Maybe, maybe they nab a drunk. Maybe they strike out. (And gill-snag two perch on outstanding warrants.)

Gosh darn it Jim. I am driving out to Swanton tonight. I won't be drinking and was looking forward to going through the checkpoint.

I was looking forward to citing the 4th amendment and 5th amendment and NOT answering any of the questions that these overtime grubbing neo fascists might ask me.

If I ever get caught in a checkpoint, I am going to announce that I am an American citizen and I demand that the US embassy be contacted.

A moderately interesting article. I tweeted the author about some remaining questions I had. Specifically-the article mentions that they routinely announce these a week ahead of time, but I only notice these, maybe a day or so in advance, and with no consistency. Also-as we've discussed-locations seem weird, the OSHP says they are based on arrest data, I still find that suspicious.

Also, they acknowledge the 1% or so success rate, they erroneously cite the arrests as equal lives saved.

Yeah. That failure in logic stopped me while reading. And it was attributed to a single OHP officer. I don't want him pulling me over. Sober. Going the speed limit. Properly. Still don't want to spend time with him.
He also said something about "not having anything to worry about if you are innocent."
Same goes for cavity searches in foreign airports. No big deal. I'm innocent. Let's do this.

Just wait until 2:30 AM when the Irish pub finally closes, and ten minutes later the cops bust some fool driving a golf cart down the freeway, bawling out Finnegan's Wake at the top of his lungs with a leprechaun riding shotgun.

Nights like this is why I don't envy the police. Pull some drunk over, and it's likely to turn into a foot race, then it's off to the Donnybrook Fair. After the schmuck gets cuffed and stuffed into the back of the squad car, he ralphs all over the place and someone (not the drunk, oh hell no!) has to clean up the used Jiggs Dinner and beer.

Me, I'm staying home.
